We are Legal Experts at Resolving Trip and Fall or Slip and Fall Accident Cases

One of the most common causes of serious injuries in the personal injury realm is a trip and fall or slip and fall incident. People are injured every day in New York and New York City when they slip or trip and fall due to dangerous slippery conditions or tripping hazards such as a wet floor, defective staircase, or divot in concrete or asphalt. Building owners and their contractors are responsible for the dangerous slip/trip hazards they may create or fail to maintain or repair. They are responsible for those dangerous conditions on their property that they should have discovered and fixed. The insurance company should compensate the injured person with enough money to cover the economic losses and pain and suffering caused by the negligent owner, contractor, or landlord’s actions or inaction. That is their contractual obligation and the reason why they collect premiums from owners of real property, contractors, renters, etc. Unfortunately, they usually do not pay reasonable compensation to the injured party without first forcing a lengthy legal battle.

We are fully prepared to represent your interests and painstakingly demonstrate the merits of your claim of negligence and injury to the insurance company’s adjusters.

When someone is injured in a slip and fall accident, it is especially important that they take photos/videos of the defective condition, the surrounding scene, the presence of any surveillance cameras, and any injuries for evidence. Obtain the names and contact information of any witnesses, In order to help you preserve evidence and protect your compensation claim following a slip and fall accident, reach out to our top, skilled personal injury lawyers as soon as possible. We know how to gather and preserve any evidence at the onset.

The lawyers at Peter DeFilippis & Associates have a long history of getting outstanding results for clients.  A  good Westchester trip/slip and fall lawyer knows what legal steps need to be taken in order to preserve evidence from destruction by parties at fault and establish your claim. If you were injured in a tripping or slipping accident, call today to schedule a free consultation.

Slips and falls happen anywhere from residences, retail stores, apartment buildings, parking lots, and playgrounds. Property owners have a legal obligation to provide a safe environment for residents, visitors, and customers. When property owners are negligent in their duty to provide premises that are reasonably safe and free from hazards, those injured have a right to claim damages for their legitimate injuries. While not all accidents that occur on the property of another party will lead to liability of the owner, you should consult with an attorney who is experienced in liability laws to determine the nature of the property owner’s duty to provide a safe environment for visitors, workers, and customers.

We obtain the best results possible, for one example, we represented a physical therapist in her early 50s who fell when pushing open the outer door of a restaurant leading to steps, which contained too much tension and were missing the door handle and side handrails. Mr. DeFilippis proved at trial that because of a number of previous incidents when patrons attempting to leave dropped food and drinks while turning the outer door handle, the owner further created a dangerous condition by then removing the entire handle and latch. Plaintiff testified when she began to fall, she had no door handle or handrails present to catch her fall. An expert architect testified that seven building code violations contributed to the incident. After the fall, she was writhing in pain for some period until assistance came having suffered a trimalleolar ankle fracture requiring an open reduction surgery with hardware placement. A second surgery was needed approximately six months later to remove the hardware. There was no loss of income claims. A surveillance video of the entire fall was intentionally destroyed by the owner. The owner testified on cross-examination that numerous patrons had had accidents involving that same situation yet he made no proper repairs. The Putnam County jury found 100% in favor of Plaintiff after deliberating for only 15 minutes. The case was then settled with the insurance company insuring the restaurant business and the defendant owner for $625,000.

Premises liability is a complex area of the law that often involves multiple defendants and causes of action. Having an experienced personal injury attorney can help increase your chances of recovering compensation. If you need an experienced slip-and-fall or trip-and-fall accident attorney, the lawyers at Peter DeFilippis & Associates help accident victims get the justice they deserve. Our goal is to get you the best result possible and achieve the maximum settlement value or verdict award for your case. We Have Successfully Handled Many Wrongful Death Matters

If you recently lost a loved one caused by someone else’s negligence, you likely have questions about what lawyers term, “wrongful death” lawsuits. Searching for answers, you may have heard about wrongful death claims, or even been advised by friends or family members to consider bringing a wrongful death case. A successfully processed wrongful death lawsuit can help alleviate financial concerns caused by the death of a loved one, although it, of course, cannot put an end to the emotional pain that the family continues to face.
.
Wrongful death is a type of personal injury claim that arises out of other personal injury claims such as car accidents, slips, and falls, medical malpractice, and motorcycle accidents. A wrongful death claim can come from any type of personal injury claim; however, the damages in a wrongful death claim are different from those in a typical personal injury claim. In some cases, the victim’s family may be allowed specific types of damages while the victim’s probate estate may be entitled to other kinds of damages.

In order to ensure that the family receives all of the damages that they are entitled to receive from the negligent party’s insurance company, they should consult with our experienced wrongful death attorneys as soon as possible following the accident.

We’ve Had Oustanding Results Processing Automobile Negligence Cases for Over Three Decades

Car accidents happen every day in New York City, Westchester, Putnam, and The Bronx. If you were seriously injured in a car accident, you should learn your legal rights and avoid the common mistakes that the insurance companies hope you will make going it alone. It is important to consult with an attorney immediately to avoid those pitfalls. While the No-Fault Insurance carrier is responsible for covering your basic economic loss, including medical bills, the liability insurance company for the negligent party may be required to compensate you for those damages beyond no-fault benefits, including pain and suffering. You must establish the other party is at fault in order to seek compensation for non-economic damages. Remember, insurance carriers are businesses. They make money by trying not to pay out claims. They will not voluntarily pay claims where they have no legal obligation to do so. The injured person must show why the other driver was negligent: what rules of the road were violated and what sections of the vehicle and traffic laws were broken. This is something the lawyers at Peter DeFilippis & Associates have been doing for three decades. Don’t start filling out forms and signing documents you do not understand. Instead, please speak with our knowledgeable attorneys and avoid making any irreversible errors early on in the process.
